The Protection of Freedoms Act 2012

The Protection of Freedoms Act 2012 became law on May 1st 2012. The Act introduces a number of significant changes which affect churches.

  1. It tightens the definition of a Regulated Activity.
  2. Children aged 16 and under should no longer be DBS checked - this is now illegal.
  3. The Criminal Records Bureau and the Independent Safeguarding Authority merged to form the Disclosure and Barring Service.
  4. DBS Disclosures remain for all prescribed positions but ISA barring checks are limited to Regulated Activity roles only.
  5. Disclosure certificate to be dispatched to applicants only and no copy will be sent to the Registered / Umbrella Body.
  6. Launch of an online continuous updating and portability scheme in early 2013.

Please remember that DBS checks should only be a small part of your recruitment and safeguarding activity. You need to follow proper recruitment procedures and proper supervision rather than simply rely on a clear DBS check.
